The electricity-generating utility Eskom is taking legal action against a coal supplier in respect of financial prejudice the utility suffered.

According to Public Enterprises Minister Barbara Hogan, giving a written reply on Monday to a Parliamentary question from Cobus Schmidt of the Democratic Alliance, a claim for R80 877 425.31 has been made.

"Eskom has instituted legal action in the form of arbitration proceedings against the relevant parties in respect of the financial prejudice suffered by Eskom," Hogan said. "The cause of action relied upon by Eskom is in the main breach of contract, negligent misstatement (and) unjustified enrichment."
